These are the terms and conditions for our self-guided walks. Our guided walks are governed by the Terms and Conditions of Airbnb Experiences.
1. Introduction
1.1 Use of this site is subject to these Terms and Conditions.
1.2 Use of this site constitutes by the Purchaser acceptance of these Terms and Conditions.
1.3 Please read these Terms and Conditions carefully before downloading or purchasing a self-guided walk, as you will be required to confirm that you agree with these Terms and Conditions when you submit your order.
1.4 Sussex Walks reserve the right to change these Terms and Conditions at any time.
1.5 If any of these Terms shall be determined to be unenforceable by reason of Law, then to the extent that a Term is held to be illegal or unenforceable, it shall be deemed to be severed, and remove from the relevant Clause so that all remaining Terms and Conditions shall remain in full force.
1.6 These Terms and Conditions should be governed by and construed in accordance with English Law.
1.7 The failure of Sussex Walks to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a formal waiver.
2.Information on this site
2.1 Whilst Sussex Walks will endeavour to ensure that the information on the site is correct no warrantee, express or implied is given as to its accuracy. Sussex Walks do not accept any liability for any error or omission.
3. Access to this site
3.1 Sussex Walks shall not be liable if this site is unavailable.
3.2 Sussex Walks does not guarantee that the site will be free of viruses or other harmful components.
4. Limitation on Liability and Exclusion of Liability upon Sussex Walks
4.1 It is hereby agreed that Sussex Walks shall not be liable for any damages including, and not by way of limitation, for any loss of business or loss of profits arising in Contract, Tort or otherwise from the use of or inability to use this site or any material or Treasure Hunts contained on the site or from any action taken by the Purchaser or on his behalf arising from the use of this site.
4.2 Sussex Walks entire liability to you in Contract, Tort, and negligence or otherwise in relation to orders placed on this site shall be limited to £500 for any one incident or series of related incidents.
4.3 Save as expressly set out in these Terms and Conditions any warranties or obligations implied by Statute or Common Law or Common Usage or by a course of dealing shall be excluded to the fullest extent permitted by Law.
4.4 It is hereby expressly agreed that any Purchaser of any walk purchased from Sussex Walks shall be solely responsible for their safety and their property and any party undertaking the Trail. Sussex Walks cannot be held responsible for any loss or damaged property.
4.5 Nothing in these Terms and Conditions shall limit Sussex Walks liability for death or personal injury caused by negligence.
5. Using this site
5.1 The Purchaser acknowledges by using this site that any copyrights, trademarks, patents or other proprietary rights and laws in favour of third parties are hereby recognised and acknowledged.
6. Proprietary Rights
6.1 All words, images and downloads on this site are the property of Kathryn Burrington
6.2 The Purchaser acknowledges and that any Trail that has been purchased is for the personal use of the Purchaser and their guests invited by the Purchaser to undertake the Trail.
6.1 The Purchaser will not allow third-parties who are not guests of the Purchaser to use any Trail that the Purchaser has purchased.
6.2 The Purchaser acknowledges that the Purchaser will not resell or make publicly available any Trail for other parties to use without an expressed written consent of Sussex Walks.
7. Refund and Cancellation Policy
7.1 Sussex Walks does not offer refunds for any Trails provided to the Purchaser and once payment has been made cancellation is not possible.
